Stare Decisis is a doctrine following rules or principles laid down in previous judicial decisions unless they contravene the ordinary principles of justice. This is also known as legal precedent.
The decisions of prior cases should drive the decisions of current cases. The cases that reach the Supreme Court of the United States shape the future of law and correct past errors.
Discussion Question:
Should the Supreme Court follow Stare Decisis? Take a position and defend it with evidence from your readings or the videos.
Each student is required to post a 200 word response to the question.
