Unit #B The 14th Amendment and the Incorporation Doctrine Section #2
SPECIFIC INSTRUCTIONAL OBJECTIVES:
- Understand the nature and operation of U.S. political institutions and processes under the Constitution as amended and interpreted.
- Provide critical analysis of the rights and obligations of citizens in the political system established under the Constitution.
- Identify the functions of the Three Branches of Government (Executive, Legislative and Judicial).
- Compare and contrast constitutional guarantees of citizen's rights and liberties.
The Incorporation Doctrine-
The Incorporation Doctrine is the legal theory that brings the fundamental rights of the US Constitution into the states. The Civil War era 14th Amendment was constructed to reverse past Supreme Court decisions (Barron v. Baltimore and Dred Scott v. Sanford )and establish a foundation to ensure fair and equal rights and procedures for all on US soil.
